Benefits of an Uncontested Divorce

By: James Walsh

The fact that an uncontested divorce is cheap and easy on your pocket may not be very significant for some millionaires and billionaires who have many estates and funds to divide and do not mind spending money on high street solicitors and fighting to claim as much as they can. However, for most of the average couples, a contested divorce may translate in to huge litigation costs which they can not afford to spend, given the fact that most of their settlements are moderate. Contested divorces may drag on for a long time, sometimes for years. These large litigation expenses may even exceed the maintenance or settlement that the person was putting up a fight for in the first place. It may not amount to anything in the end. As the fight goes on, one may be tired and fed up of the whole thing and could even be willing to settle for lesser than what he or she had hoped for in the beginning. Thus, an uncontested divorce can prove to be very economical as no expensive legal aid is required and the money saved can be utilized to start afresh.

It takes very less time, a few weeks on an average, and thus one can be rid of this distressing situation as early as possible. It is also much less taxing on your emotions. Most of the people work for a living and it usually takes up much of our time. The rest of it, one rather spend doing something enjoyable than attending divorce sessions in the court. No frequent attendances in the court are needed and so, there are no hassles. It could also help retain your social standing. A contested divorce is akin to washing your dirty laundry in the public. There is a lot of mud-slinging and name-calling associated to prove oneself better than the other. An uncontested divorce can be done in the privacy of your home in a civilized manner and both the partners can walk away non-traumatized. Although, a divorce can hardly be described as something that makes a couple happy, for many, this signifies a new start in life and it need not be accompanied by an emotional baggage of hurts and accusations. The legal hassles are very less. Convenient forms are to be filled in and submitted. Infact, many such services are available online which promise a quick, hassle free divorce which has to be uncontested, however.

The most crucial part is the role an uncontested divorce plays in sparing your children from the ugliness of divorce. It is ‘softer’ on children and doesn’t malign their view regarding social institutions such as families, family values and their parents. If they can’t be spared from breaking up of their family, they can at least be cushioned by not having bitter fights. Moreover, with an uncontested divorce, there is usually an attached clause of shared parenting which benefits the children as they still get the affection and company of both the parents, unlike contested divorces, where parents fight for the custody of heir children and try to undermine the visitation rights of their rivals. It can create distrust and suspicion in the minds of the children for either or both of their parents. It can have damaging effects on their psychological development. An uncontested divorce will allow the partners to retain amicable relationship and only then they work together to get the best out of the situation.

Although, a divorce can legally dissolve a marriage, it remains a fact that memories can’t be dissolved. It is, thus, in the best interest of everyone that only the happier memories of the relationship to be retained and the unpleasant ones to be allowed to fade away. This can only be possible if the separation has not involved unwanted contests and fights. If it has to end, let it end in peace.
